ES Gallon and Associates is the oldest workers’ compensation law firm in the Miami Valley area.

My parents are originally from Germany, but proudly became U.S. citizens shortly after immigrating to this country in 1952. My father worked for over 40 years in construction. After my two brothers and I were all in school, my mother worked in a factory. I grew up in a working class family and worked by way through college and law school. (I was lucky in that my earnings were supplemented by a scholarship that I earned, based upon grades, test scores and extra-curricular activities, through my mother’s employer.)

Joe Ebenger’s personal commitment to helping injured workers stems from a dangerous workplace accident that nearly took the life of Joe’s father when Joe was just a boy.

The late Elton S.—Chuck—Gallon was born in 1924 to parents Joe and Sade Gallon. A native of Toledo, with one year of college, he enlisted in the U.S. Army in November 1942. After serving, he returned to school and obtained his bachelor and then his law degree, in 1949, from the University of Denver. He came to Dayton, where he began practicing law in 1950. He focused on the representation of injured people and those in labor unions.
Chuck’s younger brother, Jack, was also a lawyer with labor law ties in Toledo. Jack’s firm, now Gallon, Takas, & Boissoneault, was incorporated in June 1973. The brothers were close, and Chuck followed suit: E.S. Gallon Co LPA was incorporated in December 1973. In 1974, Patrick W. Allen and David M. Deutsch joined Chuck and became his first shareholders.
At the time of his death on July 15, 1985, 17 attorneys, including Joseph R. Ebenger (who became a shareholder in 1980), James R. Piercy (who became a shareholder in 1982), and Joan B. Brenner (who became a shareholder in 1986), and more than 100 employees worked at E.S. Gallon & Associates.
Chuck was shy and shirked the limelight, preferring to work behind the scenes, but encouraged and supported his shareholders and associates to be active and engaged in local and national legal organizations and community activities. His shareholders described him as “a visionary pioneer” in his generosity by giving back to the community. He sponsored clients through vocational rehabilitation (cost of schooling for retraining) and clients’ families at Christmas (with money for gifts).
Chuck served on the Governor’s Committee for Rehabilitation of Injured Workers under Gov. James Rhodes, and on the board of the Legal Aid Society. In 1998, he was posthumously inducted, by the Ohio Trial Lawyers Association (OTLA), now Ohio Association of Justice (OAJ), into its Workers’ Compensation Hall of Fame.
